Arbitration, a form of alternative dispute resolution (ADR) is a legal technique for the resolution of disputes outside the courts, where the parties in a dispute refer it to one or more persons they agree to be bound.

Tom Brabazon is qualified to act as an official arbitrator being a Fellow of the Chartered Institute of Arbitrators and a member of the Irish Branch.

Arbitration is very much like going to Court except that there is no appeal and the result of the Arbitration is binding in the same way as an order of the High Court. Some disputes are suitable for Arbitration and some are not so it is very important that the right advice is obtained depending on the nature of the case.

Arbitration can arise from a contractual relationship of the parties or parties to a dispute can agree that it is important to get to the stage of a hearing and a decision quickly and can agree to submit to Arbitration.

Arbitration by comparison to litigation in the High Court Commercial Division for example is much more cost effective and in certain types of dispute the privacy of the parties is respected fully so that the media don't usually get to hear what is going on in relation to a dispute which might be particularly commercially sensitive, for example.

This is a relatively burgeoning area of practice and Dublin is becoming a centre for ADR and Arbitration on the international stage.
