There are two main issues to be considered in assessing any personal injuries case. Firstly there is the question of liability – ie are the proposed defendants liable in law to you for what has happened?
If the answer to the first question is yes then you move on to the second question – what is the quantum or the value of the case? This can be as equally complicated as the first question but in an injuries case this is usually assessed on the basis of the Medical Reports received from your GP or your Medical Consultant (General Damages). On top of that then you add items such a specific financial losses, eg, loss of earnings, damaged car, cost of repairs, medical, pharmaceutical, physiotherapy bills and travel (as examples of Special Damages) to come up with a quantum figure which guides as to which court to issue your proceedings are taken in ie District Court, Circuit Court or High Court.
